“Invite A Friend” Program Official Rules

The “Invite A Friend” Program is sponsored by Specialty Retail Solutions, LLC dba WhizBang! Retail Training and is open to legal residents of the United States and Canada who are 18 years of age or older. This program is subject to federal, state, and local laws and regulations and void where prohibited by law. WhizBang! Retail Training’s employees, as well as members of an Employees’ immediate family and/or those living in the same household of Employees are ineligible to participate in the “Invite A Friend” Program.
The “Invite A Friend” Program Entry Period: This program begins on May 1, 2021 at 8:00 AM Eastern Time and ends on June 6 at 12:01 AM Eastern Time.
Agreement: By participating in this Program, the Participant (“You”) agrees to abide by WhizBang! Retail Training’s Official Rules and decisions, which are fully and unconditionally binding in all respects. As a Program participant, You must fully meet all Program requirements, as specified in the Official Rules, in order to be eligible to earn a commission or additional Bonus Rewards. You agree that Your actions as a Participant will comply with all applicable laws. During the term of this Program, You will not produce content that is, in our opinion, unlawful, harmful, threatening, defamatory, obscene, harassing, racially, ethically, or otherwise objectionable or are in violation of these Official Rules. You also agree that You are at least 18 years of age. Those that do not adhere to the Official Rules or specifications will be disqualified at WhizBang! Retail Training’s sole discretion.
Relationship to WhizBang! Retail Training: The Participant is an independent contractor, and nothing in the Program or in these Official Rules will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf.
Referral Link: To participate in the Program, WhizBang! Retail Training will make available to You a custom, personal URL (“Referral Link”), which will serve to identify You as the referrer. When a third party purchases a Retail Success Summit registration from WhizBang! Retail Training using Your Referral Link it identifies that third party as Your qualified Referred Attendee.
Eligible Referred Attendees: You, Employees of Your company(s), as well as members of Your Employees’ immediate family and/or those living in the same household of Your Employees are ineligible to become Referred Attendees. Fraudulent methods of entry or circumvention of the rules may result in WhizBang! Retail Training invalidating Your entries and removing them from the Program at WhizBang! Retail Training’s sole discretion.
Commission Fee: You will be paid a commission fee (“Commission Fee”) of $50 of the total payment paid to WhizBang! Retail Training by each eligible Referred Attendee that registers for the Retail Success Summit using Your Referral Link. Registrations that are cancelled will earn no Commission Fee.
Order Processing: WhizBang! Retail Training will process orders placed by third parties. WhizBang! Retail Training reserves the right, in its sole discretion, to reject orders that do not comply with any requirements we now have or may establish in the future. WhizBang! Retail Training will be responsible for all facets of order processing and fulfillment, including service, cancellation, processing, refunds and payment processing.
Order Tracking: WhizBang! Retail Training will track Referred Attendees. To permit accurate tracking, reporting, and Commission Fee accrual, You must use Your own Referral Link, properly formatted, whenever You invite third parties to register for the Retail Success Summit. Only eligible, qualified registrations for the Retail Success Summit made using Your Referral Link will be counted toward Your commission fees and Bonus Rewards.
Bonus Rewards: The ten (10) participants with the highest number of Referred Attendees in the “Invite A Friend” Program will receive Bonus Rewards in addition to the Commission Fee. The Bonus Rewards(s) shall be determined solely by WhizBang! Retail Training. There shall be no cash or other prize substitution permitted except at WhizBang! Retail Training’s discretion. The Reward is non-transferable. The participant, upon acceptance of the Reward, is solely responsible for all expenses related to the Reward, including, and without limitation, any and all local, state, and federal taxes, fees, licenses or other expenses. By accepting the Reward, the participant grants permission for WhizBang! Retail Training to use the participant’s likeness and name for purposes of advertising and trade without further compensation unless prohibited by law.
- The participant with the highest number of Referred Attendees will earn as a Bonus Reward the Wolf Lucky II – 150CC Scooter delivered to an address of their choice in the 48 contiguous United States or mainland Canada.
- The participant with the second highest number of Referred Attendees will earn as a Bonus Reward the RadWagon 4 Electric Cargo Bike delivered to an address of their choice in the 48 contiguous United States or mainland Canada.
- The participant with the third highest number of Referred Attendees will earn as a Bonus Reward the Yeti Hopper Backflip 24 Soft Cooler plus 4 WhizBang! Pint Glasses delivered to an address of their choice.
- The participants with the fourth through tenth highest number of Referred Attendees will earn as a Bonus Reward, 2 WhizBang! Pint glasses delivered to an address of their choice.
Notification and Payment of Commissions and Rewards: Commissions and Bonus Rewards will be paid out after the completion of the Retail Success Summit. WhizBang! Retail Training will notify You no later than June 30, 2021 via email with information about receiving Your commission fees and/or Bonus Rewards.
- WhizBang! Retail Training is not responsible for, nor shall have any liability for participant’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall be WhizBang! Retail Training be liable for the participant’s provision of incorrect or otherwise non-functioning physical location contact information (mailing address).
- If the Participant 1) fails to claim the commission and/or bonus rewards within sixty (60) days from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified time frame, the bonus rewards may be forfeited and the next highest referrer will be awarded the Bonus Reward.
Rights Granted by You: By participating in this Program, You understand and agree that WhizBang! Retail Training, any individual acting on WhizBang! Retail Training’s behalf, and the licensees successors, and assigns of WhizBang! Retail Training shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, Your name, photo, portrait, voice, likeness, image, statements about the in “Invite A Friend” Program, and Your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.
Terms & Conditions: In its sole discretion, WhizBang! Retail Training reserves the right to modify, suspend, cancel, or terminate the “Invite A Friend” Program should non-authorized human intervention, a bug or virus, fraud, or other causes beyond WhizBang! Retail Training’s control, impact or corrupt the security, fairness, proper conduct, or administration of the “Invite A Friend” Program. WhizBang! Retail Training, in the event of any of the above issues, may determine the Commission Fees and Rewards based on all eligible entries received prior to and/or after (if appropriate) the action taken by WhizBang! Retail Training. Attempts by any participant to deliberately damage any website or undermine the legitimate operation of the “Invite A Friend” Program may be in violation of criminal and civil laws. If any such attempt is made, WhizBang! Retail Training reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability: Your entry into this Program constitutes Your agreement to release and hold harmless WhizBang! Retail Training and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Program and/or the 1) Participant accepting, possessing, using, or misusing of any Bonus Award or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Program administration or processing.
Disputes: THIS PROGRAM IS GOVERNED BY THE LAWS OF THE UNITED STATES AND MICHIGAN, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. The Participant agrees, as a condition of participating in this promotion, that if any disputes cannot be resolved between the Participant and WhizBang! Retail Training, and if causes of action arise out of, or are connected with, this Program, they shall be individually resolved exclusively before a court located in Michigan having jurisdiction, without resorting to any form of class action. Under no circumstances in any such dispute shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Participant). The participant waives all rights to have damages multiplied or increased.
